my future ex wont get out of house and told his daughter he was going to tear my house apart

If you are in fear of your own physical safety you can obtain a protective order and he will not be allowed in the house. You should take movies or pictures of your house now. I do not know what you mean by your ex. Ex boyfriend? Ex husband? It may make a difference if there is a decree of divorce.
