Legal Question in Civil Litigation in Indiana
My ex-spouse sued me for alienation of the childrens' affection and for reporting my childrens' allegations of sexual abuse by ex-spouse's new wife's kids. After 2 yrs of family therapy the counselor informed the two sides that there is no evidence that mother alienated the children, and the ex-spouse's attorney finds no evidence me reporting the sexual abuse "with malicious intent" so the ex-is thinking of dropping the 2 cases. However, he wants me to pay his legal fees. I didn't bring this case- he did. He didn't prove his case because his charges simply were not true and time and therapy have shown this. So, shouldn't I be the one who can sue him for my legal expenses? If you accuse me of breaking your window and then fail to prove it, can you then say "well i didn't prove you did it but I would like for the court to make you pay my legal expenses?

Typically a court will not award attorney fees to an unsuccessful claimant such as your ex-husband.
