Legal Question in Civil Litigation in Indiana

Failure to report abuse

Over 1996-1998 my husband filed 4 reports at the DFC that he suspected his children were being abused by mom's boyfriend and possibly sexual abused by someone because of their actions and words. Dfc never investigated. His son (then 6yrs) told a LCSW that he was abused and the counselor never reported. Today, his son (16yrs) is in a facility for molesting 9 girls in their sleep, including his younger sister and a 4yr. old, and has disclosed that he was indeed molested. Can we sue DFC and LCSW? Also, his mom allowed him to have access to 2 of his victims AFTER she was aware that he had molested his sister. (total of 7 offenses while at her home) Shouldn't she be held responsible also? (Moms involvement is too complicated for this post.) Bty, dad has joint legal custody of both children, physical custody of son. Thank you

Re: Failure to report abuse

In my opinion, the statute of limitations has run and you could not sue them.

Re: Failure to report abuse

This is far too complicated for a short answer or to truly provide an opinion. You really need to contact an attorney for a consultation. generally speaking, statutes of limitations on minors are far longer then adults.
