Legal Question in Civil Litigation in Indiana
My husband has a wage garnishment. When he and his ex-wife split several years ago, they had a loan for $16,000. The argued over it, he lost and she had him garnished. On 12/7/09, he had the loan down to $12,666.60. Around the point and we're not sure when, she paid the loan off at the bank and made herself the judgment creditor and imposed 12% interest. She claims it's compounding daily. According to payroll records, he has paid her the $12,666.60 plus costs, but she is claiming it is no where near paid off and she will not provide us with any records to support her claim. But the garnishment continues and he is sending $143.50 a week. It's a heavy financial burdon and we are going under. Any advice? We reside in Indiana, but the ex is in Kentucky and the garnishment is thru Kentucky.

You will need to retain an attorney to check in to the exact terms of the garnishment order and the records of how much has been collected. You may need both Indiana and Kentucky counsel, but start with an Indiana lawyer and work from there. This is too complicated to resolve by yourself.
