All debts and asset that either party has may be divided by the court in a divorce, no matter whether they are individually incurred debts or individually owned property. The creditors themselved have no right to pursue the debt against the spouse who did not incur the debt by signing the note, agreeing to the credit card, or whatever the debt might be.
