Legal Question in Civil Litigation in Indiana

Paypal/ebay

Bought an item on ebay using paypal, filed a dispute to send item back and get money back. Got an email from paypal saying we won the dispute but no money was given back. Upon calling paypal they said a email was missed so the claim was closed. Now the buyer has his item back and still has the money. Can we take him to small claims to get money back?
