return a used car, Indiana
My son purchased a used car and all the paperwork had been signed Friday 5/22/09. Before picking up the vehicle on Friday 5/22, we had asked the salesman as well as finance manager equalling 3 times for a carfax report. We never received one and in the meantime my son had his father run the vin # and found that the previous owners the car had been broken into and the tailgate and that the rear suspension is bad. He washed the car and the tailgate leaks water. We brought the car back yesterday 5/25 and asked the dealer to fix these problems or we want our money back. They called today and said they will fix under the owners expense. This is ridiculous. He paid $16,000.00 for a vehicle he hasn't owned for 72 hours, they never explained as is nor did they ever give us a carfax report as asked 3 different times to 2 different people.
Can we do anything? What are our rights?

Unless there was a misrepresentation concerning the condition of the vehicle, there is little that you can do. You should have insisted on the carfax before making payment and signing the papers, not after. If there were representations made that the car had never been broken into, etc. then you may have a cause of action. Good luck.
