Legal Question in Civil Litigation in Indiana
My sister, a widow gave her husbands nephew (45 yrs old) and his girlfriend (38 yrs old) a temporary place to stay as they were homeless. She was at work last Saturday and they were cooking French fries and burned her home of 30+ years down. They killed 3 of her 4 pets in the process and her nephew received minor Burns on his right hand, he was kept overnight for observation at the hospital. His girlfriend was treated and released for smoke inhalation; they got their dog out with them. These two leeches have not worked a day since arriving at my sisters house, she has provided for them. Now they act as if she owes them! She is having issues with her homeowners insurance and they are denying the claim. I advised her to get an attorney and litigate against the nephew and girlfriend before they litigate against her. These people expect her to pay for their every need and when she hesitates, she is reminded "it was your house". Do you agree that she should file against them first? They have taken everything from her and keep trying to get more daily. I feel that she needs a court of law to show them that they are at fault even if she never collects a dime on judgement. It will also keep them from getting a suit against her, correct?

I agree with your first advice, she needs to talk to an attorney as soon as possible.
