Legal Question in Civil Litigation in Indiana

Small Claims Court Notice-Summons

I was delivered witha one sheet piece of paper yesterday saying it was a notice for my appearance as the defendant in a small claims court filed with Delaware County Indiana specifying it was from the State of Indiana. Who is suing me the state of Indiana or an individual. I wasn't required to sign the paper, the guy just gave it to me and left. I will soon be getting a divorce from my husband in February and can't figure out if this is from him or the state of Indiana or both? Can you shed any light on this for me and how am I supposed to respond to this and how soon? Isn't a person usually told what they are being sued for and who is suing. This is all a mystery to me. Please help.

Re: Small Claims Court Notice-Summons

Those small claims forms tend to addle me, so it's no wonder to me that you would be confused. Somewhere in the body of the notice of claim there should be the name, address and telephone number of the person to contact. So try calling that person. In any event, be sure to appear at the time specified so you can defend yourself. Good luck.

You should be able to see who is suing you on the complaint itself. If not, call the court, give them the cause number and ask who the plaintiff is.
