Small Claims issue

Hi my question is how can i get my stuff back, my ex is withholding my tv, stero, fan and my blanket from me which my tv and fan was bought by me my stero and blanket by my parents so i have no proof tht these are my things besides people seeing them in my house before i moved in with him(ex boyfriend) my brothers and i have the same tv's and parents being able to tell the judge tht they bought those other things for me.for christmas. Hes refuseing to give me my stuff back now b/c its been about four months since ive moved out and he packed my other belongings up for me all but the stuff mentioned above everytime i asked for them he said he would bring them to me i even have a voicmail saying i could get mystuff from him but hes refusing now. so do u think ill be able to get mystuff back in small claims court? thank you

For technical reasons, the small claims court can not order him to return those items. However, the court can order him to pay you the value of those items. My suggestion is to go ahead and file. Even though the court technically shouild not order the return of the items, the court may do so anyway. Practically speaking, if the court awards you the value of the items, chances are he will return them. He may even do so as soon as he receives court papers.
