Legal Question in Civil Litigation in Indiana

my space web site

i have a profile on myspace.i really like the site. They have a bulletin board where you can post things for your friends to see.Well here lately they have been letting ad agencies post bulletins in our name. With no permission.Normally I wouldnt care, but these say things like (looking for hot and horny girls,I found them at this site). Then there is a URL posted under it.

Twice now I have had to reassure my daughter that I was not out looking for other women. Also since kids are on this site,I figured it would be illegal for them to advertise adult content.

I want to see if I can bring some kind of legal action against them.It has also caused major problems with my girlfriend.Wouldnt that be like deflamation of character or something

This is very embarrasing.I have been with my fiancee for 15 years now.All my friends and family see this. And it is degrading because I know some of them dont believe me.When I tell them I didnt post it.

I have sent them an e-mail asking them to stop. They never responded and it keeps going on.

Can someone help me.I hope

Was there a user agreement that you had to acknowledge before you were able to establish a myspace identity? If so, did you keep a copy. You might have agreed to allow advertising. I suggest that you try to find your agreement. Hopefully, you printed it.

Without knowing the contents of the agreement, I can not provide you with an opinion.
