During Storm Neighor's Trampoline Hits My House

My neighbor had a trampoline in back yard. We had a storm and wind picked up trampoline (which was not anchored to ground) and it flew into my fence and then my house, damaging the fence, guttering and siding on my house. Neighbor said he'd take care of it but now is avoiding me once he found out his insurance wouldn't cover it. The deductible on my insurance is more than the cost to have the damage repaired. Who is responsible for taking care of damage? Thanks.

Your neigbhor is responsible for all damages caused by his negligent conduct, which would include leaving his trampoline unanchored. And, his homeowners insurance company will pay all your damages. Tell your neighbor to threaten his homeowner's insurance company with bad faith denial of third party claim. Your neighbor should consult an attorney. You should sue the neighbor in small claims court, the small claims amount is sufficient to cover your damages. Good luck.
