i am being sued in a matter of paternity by the father of the girl whom i hadn't had sex with for over a year before she got pregnant, she recognizes this, he recognized this, the child has his last name, but, now that they have split and she want child support he's trying to put it off on me, this has created a problem between my son's mother my girlfriend who has lived with me for over a year now, i want to sue the state for putting me through this, he's contesting he should have to pay for a test.

Pay for the test. Once the results come in excluding you, sue the mother for damages if she knew there was no way you were the father. You won't be able to sue the state. The mother is the one with the rights to pursue you; the other guy can only pursue his own exclusion. He can't pursue the child's rights if he is not the child's father.

You will not be able to sue the state. I also am not of the opinion that you can sue the mother since she did not bring the suit. I dont understand what you mean by being sued by the father. Can you explain this more fully please? As far as I know he has no standing to sue you unless he is doing so as next friend of the child.
