Legal Question in Civil Litigation in Indiana
I am thinking of filing a small claims lawsuit against my ex-girlfriend for personal properties that she has claimed to have thrown away, one of which was a blanket that my paternal grandmother made for me before I was born. If I was to pursue a small claim lawsuit, what would be the approximate monetary value of the blanket? I am 33, so the blanket is just as old. After all, it's not about the money to me, it's the fact that it's a very sacred artifact that I can't get back since she claims to have thrown it away. I have emailed and saved all copies, am in possession of pictures that prove ownership, and sent a certified letter to her parents stating all of this, which was intercepted by her, afterwards she called my phone and again reiterated that my property was discarded and of no monetary value. Interesting question. You would need to hire an expert to provide you with a value for the blanket. You might be able to seek three times the value for unlawful conversion. I have not researched this but there may be a claim for intentional infliction of emotional distress.
