Legal Question in Civil Litigation in Indiana

My wife was walking the dog. She allowed him to urinate on a tree in the parkway infront of a house. A man confronets her an tells her get her dog off his lawn (which is actually public property and the public is allowed to walk their pets there). They exchange words. He then grabs the leash pulling the dog and my wife into the street saying "I'm going to kill your dog!"

Is this considered assault? Do we have a right to file an official complaint?

Technically it may be. Depending on your location, you may be able to file a complaint. However, please note that it may not be public property, rahter it may be that the public has an easement and I am not so sure that the public has the right to use the easement for dog walking. Nevertheless, I would suggest a common sense approach and walk the dog elsewhere. Do you really want to take a chance on this person's mental state. If he got that upset over your dog urinating, imagine how upset he could get if a complaint is filed.
