Change of status from L2 to H1

Hi

I am currently in L2 Status and application for extension of L2 status is pending with USCIS.

Meanwhile my H1 aproved for oct ,2008. I am forseeing that my L2 extension aproval would be decided in october 2008 (Let us say on Oct 10th). So techinically i am back to L2 status on Oct 10th.

At this point can I apply for the change of status from L2 to H1 (On Oct 11th?)back as I want to maintain my H1 status.
