Legal Question in Immigration Law in Indiana
Dear Madam or Sir,
I have a friend who is 22 years old. Right now, she is out of status. She and her family came to the United States with B2 visa. Shortly after, her dad applied asylum when she was 16. She was included in the asylum application. So, she wants to verify:
1. Since she is 22 years old already, she is not eligible to be included in her dad's asylum petition for being a family member?
2. If she is excluded from the asylum petition, is she eligible to apply for F1 student visa in order to keep herself to stay in the United States legally?

1. That is correct.
2. If she is out of status, she does not qualify to change status, so the answer is no.
