H1 B Petition - Work From Receipt date Or Approved Date
Hi there,
I have been on H1 visa from Company A from Aug 2003. In Sept 2004 I moved to Company B. Comp B applied for my H1, the receipt date for the petition was Oct 7th 04. They sent the petition in the month of Sept 04 itself. The H1 B petition was approved on Dec 8th 2004.
I started working for Comp B from September 2004 itself. Is that legal or should I have started working from Dec 8th 2004 after my H1 was approved.
I am going to the US consulate to get my visa renewed. Will my working for Comp B from September 04 make a negative impact.
I would appreciate if any of the immigration lawyers can advise me.

Since the petition for extension of stay was filed in September, you may start work from the day it was sent not the date of the receipt notice.

You can legally start to work for company B when the H1B petition was properly filed, which is Oct. 7. Your work for company B before that date is illegal.
