Regarding I-751
if I am lucky to get the 751 form approved with the divorce application in file, does the immigration officer have the right to take the green card back?
My background is: I got my conditional green card in 2006. My husband and I applied for I-751 form together this early May. However he filed for a divorce in August . We have a son together.

An immigration officer can do whatever he wants, unfortunately. Nevertheless, you can defend by advising that you married on good faith; if your husband testifies to the same, you should not have a problem. Further, you can request that the USCIS adjudicate your I-751 without your husband. Find a good immigration attorney to help you. Take care and good luck.
