L2 to H1

My Wife will be travelling to US in mid of March on L2. Presently I am on L1 and planning to apply for H1 in the month of April. As I wanted to change her status to H1, I wanted to know whether there is any timeline retriction between conversion from L2 to H1. How soon can she apply for H1?She willnot be having even SSN before applying for H1. Please advice on this.

Re: L2 to H1

We presume that you mean to say your wife will be switching to H-4? She will not be able to take-up the H-4 status until October 1st (if you are seeking a non-exempt H-1B for FY 2007). If the H-1B is exempt from the cap then she should be able to get the H-4 status as soon as the H-1B status is approved for you (assuming that there are no other glitches with her/your cases).
