Hi. You can marry the person at your local courthouse or in whichever religious ceremony you so choose so long as it is recognized by the location of the marriage. You need to register your marriage by getting a license and then a certificate (upon completion). After marriage, you'll need to adjust his/her status with USCIS. This can be done by filling all of the appropriate paperwork and attending the required marriage interview at USCIS. Most of the time people can handle the marriage license and certificate portion of it but recognize the intricacies in the immigration law and retain counsel to help them through that process. If you choose to retain counsel, feel free to give us a call.
Once you get married, you need to file the I-130 & Adjustment of Status "package" with USCIS. Then you will have an interview. Once approved, your spouse will receive a 2 year conditional residency. Before the 2 years expire, you both must file another form to remove the condition, at which point your spouse will get permanent residence (if approved, assuming you both remain married). If your spouse has been arrested, used false documents, claimed to be a U.S. citizen, or has been ordered deported, then he/she might have some problems. In that case, you should definitely consult with an attorney before filing.
You can visit the USCIS website for more information:
