Legal Question in Insurance Law in Indiana
Beneficiary
If someone remarries but doesn't change the beneficiaries on their insurance policies and the new spouse does not sign away her rights, does the old beneficaries become void and the new spouse receive the full amount of the insurance policy automatically?

Re: Beneficiary
Unless there was a Decree of Divorce covering the topic, the insurance company will pay the named beneficiary upon the death of the named insured.
There is nothing automatic about changing beneficiaries because of a divorce/remarriage.
There is nothing illegal about the former spouse remaining the named beneficiary - this is often done for various reasons, including child support.
The named insured should contact the insurance agent and designate the proper beneficiary.
