Legal Question in Insurance Law in Indiana
I bought a car from someone which has a "rebuilt" Indiana title. I've had this over 2 years paying full coverage insurance through a local insurance agent. My daughter had an accident and the insurer totalled the vehicle. They state that they can only pay me 50% of the payoff due because it was a "rebuilt" titled car. Nothing was said to me about this 50% payoff when we put full coverage on the vehicle or at anytime before this accident. The car was in top shape before the accident with low miles and I have been paying 100% of the premiums and 100% of the state excise tax since purchasing the vehicle. My local agent has tried to capture more of a reasonable payoff but the insurance states they cannot give any more than the 50%. Do I have any options other than take what is offered and more on? I just want what is fair. I am not trying to take advantage of the carrier either. I could not replace the vehicle with anything equal to what we had with this payoff offer.

Was it disclosed to the insurer when the insurance was purchased that you had a rebuilt title?
