Legal Question in Insurance Law in Indiana
An employee of an insurance agency gave a certificate of insurance on an expired policy to his friend to show a non-compete had been violated. Due to this the insured loss wages and a retirement offer to the sum of $400,000 plus. Black's Law dictionary states that errors&omissions may cover this intentional act. If this is true are there any case laws to validate this?

Errors and Omissions policies can cover the intentional act of an agent, but this depends on the provisons within the policy itself and the nature of the act (i.e. whether it some how advances the interest of the insured busienss). You do not provide enough facts for me to be able to offer you a complete answer to your question. I would be glad to discuss this further with you and to take a look at the Errors and Omissions policy at issue if you would like. Larry
