Legal Question in Insurance Law in Indiana
I was in a not at fault accident twice....should both be responsible?
I was in a minor accident on 11/13/03 which was not my fault. The other parties insurance took their time with the claim. Then I was in another not at fault accident on 4/22/04. The other parties insurance paid for this claim and fixed my vehicle, which included the damage done on 11/13/03. Is the insurance company for the first accident still responsible to pay me for the damage, since I have pictures, 3 estimates, and lost time off work?

Re: I was in a not at fault accident twice....should both be responsible?
Yes, but you may have a subrogation claim by the insurance on the second accident for repayment of the sums fixed by them not caused in the second accident. You can't double dip, but the second accident doesn't relieve the first company of their liability. Best of luck
