our mortgage company is not releaseing our insurance money in a timely manner

Typically the payment of insurance monies is controlled by the language of the policy. If there is no language then insurers must make sure that payment is made within a reasonable time. The real question you need to ask is why they have not paid yet? Or is the insurance company going to deny the Claim.
