Legal Question in Insurance Law in Indiana
As a result of wind/hail storm, we suffered huge holes in our roofing that also allowed rain to come inside and damage the underlying roof structure (causing the roof to be somewhat collapsing and mold to take over)....is it legal for the homeowners insurance co to only pay for the repair to patch the hole up, paint over any water spots on the ceiling) - without paying for the damages to the roof structure itself?? Patching over seems like a temporary solution that will be disastrous later considering the support of the roof has not been addressed/fixed. I thought they had to repair the roof damage including structural support of it? Someone said the insurance company's actions would violate Indiana Tort Law....Thanks!

You need to have an attorney review the policy to determine what exclusions exist. thjis is more likely a breach of contract than a tort.
