Legal Question in Insurance Law in Indiana

My son was driving his brother's vehicle, which was uninsured since it was not being used. My son who owned the vehicle had just recently sold the truck to his brother who was supposed to be getting all the paper work done but had not carried thru with all the work. Without his brother's knowledge, my son drove the truck and had a head-on collision which is being charged to him. Not only was there no insurance, and the truck still is in his brother's name but my son's license is expired. How can this affect my son who originally owned the truck. Can the insurance company go back and cause a problem for my son whose name is still on the title even though he had sold it to my other son and had no knowledge that he was driving it?

If thee was a legitimate transfer of the vehicle, it is controlling as to ownership even though the paperwork was not fully perfected with the Bureau of Motor Vehicles.
