As a Franchise Attorney I can only say the following. It depends on the facts surrounding the download. If it was downloaded from an authorized retailer, like Amazon, iTunes, etc. as part of a promotion, you're fine. But if that's not the case, then you are likely guilty of copyright infringement. Consult with a good business or franchise attorney in your area for specific advice.
