Legal Question in Employment Law in Indiana
I have contract with a model talent agency, they booked me for a promotional gig for the superbowl. The lady told me that the pay was up to 90 days although this was not on any of the contracts, however is has been after 90 days and Im still waiting. I also am wondering if she has power of attorney does that give her right to cash my check and take her 20% out before giving it to me? Do I have a case?
1 Answer from Attorneys
The state of Indiana has some very specific laws dealing with wages. Here's what you need to do. (1) Write a letter asking for your pay (send it Certified - not registered); (2) If you are not paid within 10 days thereafter, talk to an attorney in your area to file a lawsuit (in Small Claims if the amount is under $6000.00). The law provides that they are required to pay your attorney fees and costs for failure to pay wages. But, talk to a lawyer first because it is not clear to me at this point, exactly who is your employer.
