Legal Question in Employment Law in Indiana

early termination of insurace

My wife has recently changed jobs as a school teacher and her contract says her insurance runs through 8/31/06, but school x canceled it on 7/31/06 stating that, that was there policy. Even though the contract very clearly states that it runs through 8/31. School x said they would take care of it, but we had to find out it was canceld at the pharmacy. Is her old school liable for bills occured during the month of Augest? Thank you for your time

Re: early termination of insurace

If your understanding of the contract is correct, then the school should be liable. A federal law called ERISA allows you to sue for your out-of-pocket, and be reimbursed for attorney fees. Please let me know if you would like to discuss pursuing this matter.
