Employer Won't Pay Final Pay Check

To whom this may concern:

First, I want to thank you for your time, I appreciate your willingness to consider my problem.

I've been commuting from Indianapolis to Bloomington for a temporary job. The owner hired 2 of us to fill in until she could hire a new staff. After 6 months of not hiring anyone, we gave one month's resignation notice forcing her to start interviewing replacements for us.

When we left, she hired two new people to start the following week. A few days after our final paychecks were due, she e-mailed us saying she couldn't possibly afford to pay us. We called and e-mailed several times trying to get her to commit to a payment date. She wouldn't cooperate so we wrote her a ''demand letter for payment'' she immediately sent Sean his check, but has not sent mine.

My final paycheck is 4 weeks past due, and we're sure her new staff is already there working. I know I can take her to small claims court, but I have very little time to do the leg work.

At this point, I want the full amount due plus interest and anything else I can get to make up for non-payment.

I think if a lawyer called her, she might take the situation considerably more seriously. Any other ideas?

If the unpaid wages total $800 or less, you must contact the Indiana Dept of Labor at 317-232-2655. More than $800, call me at 317-955-9500.
