Legal Question in Employment Law in Indiana
False information added to personel file
Last year I took a job through a temp agency. Due to many safety issues, I told the temp agency about it for my own peace of mind. Since then I've been trying to find another job so that I can support myself and my little girl. My job history is great... but not a single job offer.
Last Friday I updated an application with another temp agency. When temp #2 pulled up my file (from the first temp), it said ''didn't show up for factory A, didn't show up for factory B''.The problem with that is, the first temporary agency had never offered me those positions. Temp #2 gave me a copy so I can try to get it removed. Those two mistakes on my file are pretty significant with factory work. With the (about 130) positions I had previously applied for, I'm going to assume that they received the same false info.
Even though the damage is already done, I'm going to ask the temp agency that I had worked for to remove the information. Somehow I get the feeling that they will agree to do so to my face. What they might do behind my back has me worried.
I’m not sure what the best method is to approach this- whether to go it alone and gather documentation or if I should seek counsel?

Hire a lawyer to write them a strongly worded letter demanding that they remove the defamatory information. Ask the lawyer to make sure s/he demands that they include the names and addresses of the places alleged to have been potential employers where you didn't show. You should also include a Release of Information for the attorney, permitting the attorney to get this information.
