Legal Question in Employment Law in Indiana

My fiance has worked for a company on and off for over five years. He recently was re-promoted to management. After working the position for a month they want to give him a background check and he has 2 felonies. Can they legally fire him?

Please repost with whether a union is involved (not likely), whether there is a written contract and whether there is a written policy and procedures manual or employee handbook that sets forth hiring and termination policies.
