Legal Question in Employment Law in Indiana
Fired from a Non-Retaliation Firm
I was fired from Firemountain of Auburn,IN 08/16/08 for apparently be to slow, however I have always done my job the same way.I started working 08/28/07 and was injured on the job that resulted in having to have my bicep surgically reattached.I was told that I was a good worker, and yet after returning to work from the injury,my work never seams to be good enough.
Do I have any recourse for this?

Re: Fired from a Non-Retaliation Firm
You may have a claim under the Americans With Disabilites Act (ADA). File a claim with the EEOC immediately. Contact an attorney who can help steer you through the process. Ask him/her if they have any experience in this area.
Once it's filed (and you can file locally with your Indiana Civil Rights), the EEOC will investigate the claim. They will attempt to make a settlement, particularly if there is merit to your claim. They may or may not file on your behalf, and may instead issue what is commonly called a "Right to Sue" letter. At that point, you have 90 days to file your complaint in Federal District Court.
