Legal Question in Employment Law in Indiana
I was injured at work when the new material handler ran over my foot with a forklift. The boss blamed me for the injury saying I shouldn't have been that close to the forklift, even though I was answering a question for the new guy. The training I had to go through to use the forklift said repeatedly the pedestrian has the right of way over the forklift at all times. The new guy was using the forklift without going through any training and never took a drug test after the incident. I missed two weeks work and was constantly told by the boss how stupid I was, the accident shouldn't have happened, it was my fault and I needed to get my head out of my ass and work smarter than that. I returned to work December 20, 2010, worked three days then off Dec. 24 and Dec. 27 for Christmas break, returned to work on Dec 28th and was fired from my job. Would I have a case against my boss for discrimination, harassment, or negligence in my injury?
