Legal Question in Employment Law in Indiana

Left Without A Job

I am a registered nurse who applied for another similar position but was closer to home. The position was offered to me by the DON over the phone. We negotiated my salary & she gave me a start date. I resigned my present position & was paid out by the company & told to go ahead & leave being I was deemed as working for a competitor. After a week, I contacted my new employer to tell them I could start sooner & I was told that the person I was to replace changed her mind & did not want to leave after all. I explained that I had resigned my other position & now did not have a job. They apologized but said they checked w/ their corp. office before calling me & this was legal. I have nothing in writing. Do I have legal recourse?

Re: Left Without A Job

Your situation is not uncommon. The law provides a remedy for this breach of contract. Since you detrimentally relied on the offer of employment by quitting your job, the new employer would be liable for your damages that proximately result.
