Non-Compete

My husband was offered a job in indiana and they moved us here, that was august 2004. In May 2005 they told my husband he had to sign a confidentiality agreement because they were being audited, so without reading he signed it, a week later the head of HR signed it the dates are different. He was just recently offered another job and turned in his 2 week notice to which they counter offered him and he declined. Now they just told him he signed a Non-Compete agreement, and they will sue him if he leaves. The non-compete states he cant work anywhere in the country for 18 months in competition with them. They also said now if he stays they are not giving him the orginal offer they countered with. Is this legal.

Probably not a valid agreement, especially where it states he can't work anywhere in the country. However, he needs to speak with an attorney and have that document reviewed by an attorney before he does anything else. Do not take my word for it here but consult with an attorney. The document needs to be seen.
