Legal Question in Employment Law in Indiana

Salaried Employee and Rights

I am a salaried employee, who agreed to becoming salaried after a 12 week training period. I went salary after only 7 weeks. As a salaried employee I am required to get 45-50 hours a week. Since becoming salaried my hours have skz-rocketed to beyond 60 per week. Am I eligible for compensation after the initial 45-50 hours? Also, being a salaried employee am I eligible for Holiday pay if I work past 40 hours in that week of the holiday?

Re: Salaried Employee and Rights

The Fair Labor Standards Act ("FLSA") is the federal law that governs the payment of overtime. To be exempt from overtime, you must be paid on a salary basis, and have job duties that fall within one of the FLSA's exemptions. Without knowing more information about your job duties, it is not possible to answer your question. I suggest you contact an employment attorney or do further research yourself on the Department of Labor's website. Many law firms, including my own, offer a free telephone consultation.
