Legal Question in Employment Law in Indiana

Tuition Reimbursement Repayment

I work for a company that requires repayment of tuition reimbursement if you leave the company. I had always been under the impression that I would only have to repay this tuition reimbursement if I left the company on my own. I assumed that if I was terminated by the company, I wouldn't be held responsible for this amount. The reason I believed this, is the way that the tuition reimbursement form is worded: ''I understand that if I terminate my employment with [name of company], I will repay the Company for tuition reimbursement made per the schedule below. I authorize [name of Company] to withhold any repayment amounts owed from my final paycheck and my final vacation, if any.'' You can see why I would think that I would only have to repay it if I left the company on my own will. It says, ''If I terminate my employment...'' I have no intention on leaving the company myself, but I may be terminated. The reason for possible termination is not for insubordination or anything I've done wrong. My manager has insinuated that I would have to pay my tuition reimbursement back if I were let go. When we questioned our Human Resources department, we never got a straight answer.

Re: Tuition Reimbursement Repayment

You are correct. Don't let them bully you into thinking otherwise.
