Legal Question in Landlord & Tenant Law in Indiana

The a/c in the apartment broke and a maintenance request was placed on October 7th 2016. Called them after a week and asked them for the status , they said that the out side temperature is not above 80 and its not an emergency. they said that they have other emergency things to do. called them again after the next week , we get the same answer , went to the management office and we still got the same response. on 28th of October sent them an email stating that it is getting hotter in the apartment and we are having a tough time to sleep with our 4 year old kid. they replied back stating that they were sorry and they are catching up on other things. called them again today and they said they have other emergency things and they are going to send a technician . somebody comes in and says that he has no idea of what is wrong. called them back and there is no response. called them back again and now they say that it is winter and they are not going to fix ac till next may 2017 . they say it is a waste of money for them to get the compressor fixed. it is getting hotter inside the apartments and we complain about that they say open the windows. if we open the windows , it is getting too much colder as we cannot regulate the temperature.

if we keep the windows closed it gets very hotter and for air circulation if we turn on the fan it blows hot air and my daughters nose bleeds.

they say that they are not going to give us a different apartment nor fix the ac and we cannot break the lease. Could a lawyer help us and give a suggestion to deal with this issue. we are stuck up and we are having a tough time sleeping and living each day and night without proper air circulation.

The landlord is required to provide you with a habitable environment. If you have documented EVERYTHING, including all conversations with the landlord, then you can go to small claims court to have the lease voided and let you out of the lease.
