Breaking Lease - Misleading Advertisement
I recently moved into an apartment building that was in the process of being renovated. When I signed the lease in April 2003 I was only planning on signing a 6-month lease; however, the leasing agent ''talked'' me into signing a 1-year lease. This was not what I had wished for; however, I signed the 1-year lease against my better judgment. On my move-in date it was my surprise that the air conditioning was not working (since been fixed 2 months after move-in), cable not working (the landlord has hired their own telecommunications company to install cable/internet) and our apartments are not wired for other service, and internet not working.
I have lived in the apartment for 5 months now and want to give my 30 days notice to vacate. I would have probably never signed the lease at all if the leasing agent would have told me the above forementioned items were not ready and would not be for months. I do not think it is my responsibility to go down their advertisement and ask if the air conditioning, cable, internet, etc. are working.
Do I have an argument for breaking the lease without penalties?

This appears to be a lease in the USA. I am not familiar with American law and therefore not competent to advise you. You should ask someone practising in the USA.
