Legal Question in Landlord & Tenant Law in Indiana

Condo Association threatening water shutoff

I have lived in my condo for over 7 years now. I owe over $4,000 in back monthly dues due to 2 prior layoffs at work that led to my current Pell Grant for college in order to rebuild and better my life.

I will graduate in May 2008 and am working at the hospital where I already have a position waiting for me after graduation next year.

I began trying to make monthly payments per an agreement with the condo association a couple of years ago, but going to school full time caused me to skip, then stop, making payments in order to use any incoming money to pay mortgage and car insurance (for clinical site destinations).

I have recently verbally agreed to begin making small good-faith payments again, and have for the last 3 months, on time, but less than the normal dues.

I am now being threatened by letter that unless I make LARGER good-faith monthly payments ($100) my water will be shut off.

In addition, the letter states that even as I am making payments, should I miss or be late with a payment, my water will be shut off.

CAN THEY DO THIS?

DO I HAVE ANY LEGAL RECOURSE?

Also, several other owners have told me that they heard of my financial problems from both the maint. man and the lady who runs the office. CAN I SUE?

I suggest taking your condo agreement to an attorney. Without seeing that document, no one can give you an accurate and complete answer.
