Legal Question in Landlord & Tenant Law in Indiana

eviction

My daughter has been evicted from her home. The county sheriff came to her house last nite and served her papers that only give her 15 days to move. She and her husband have 3 children, ages 18, 14 and 8 months. There is no way they can find a home on the income they have in 15 days. What will happen if they are not out by then? They think he will come padlock the doors, can he???

Did they receive Notice of Hearing or Writ of Restitution? I would need to review documents + consult with them to advise. I have 25 years experience in Landlord Tenant law.

If the sheriff has a court order, not only CAN he evict, he MUST.

One danger of not finding alternative housing is that the kids will be homeless. Homeless kids (especially such young ones) are likely to be placed in foster care.
