Legal Question in Landlord & Tenant Law in Indiana

I am a landlord, who had a month to month lease, with my tenant. He became three months behind and was sent a 10 day quit, to pay, or vacate, a month ago! He obviously chose neither! Currently, I do not have the money to evict him, as this was my income!

However, I am wanting to send a letter, to raise the rent and late fee's! if they aren't going to vacate and I'm going to have to file a lawsuit, I feel there needs to be some repercussions/penalties, for it!

So, my question is, how much notice do I need to give, considering they were already served an eviction?

You can start your eviction proceedings now. If you didn't have a written lease, you cannot collect attorney fees.
