Legal Question in Medical Malpractice in Indiana

Filing through IDOI for medical malpractice claim

I was unsuccessful in retaining a lawyer for my case. I was also unsuccessful in finding a lawyer on a consultation basis to answer general questions related to proper procedures.

Because I was not able to retain a lawyer, I am acting pro se and have filed my claim through IDOI (Indiana Department of Insurance).

I have several questions, but the the most important is: Is the date I filed with IDOI considered (recognized by the court and Indiana trial rules) as my official date of filing?

I am asking this question to make sure I stay within the statute of limitations. The date I filed with IDOI meets this requirement. If not, I still have time to file through the court.

You first need to determine whether the IDOI has jurisdiction. If not, then you have to file with the court. If it does, the filing at the IDOI takes care of the statute of limitations.
