Legal Question in Medical Malpractice in Indiana
Pending Med Negligence and support
My wife and I lost a son at 5 days due to an umbilical catheter intrusion and the lawsuit has begun. There is also suit for my wife and I pain and suffering. Does that incur a hike in child support? Also what if we took a stuctured settlement? Finally what are the laws with a non disclosure agreement?

Re: Pending Med Negligence and support
You should talk to your malpractice attorney concerning a non-disclosure agreement. Generally, a suit for personal injury does not result in an increase in child support as it is not income. However, an argument could be made that the interest earned from a structured settlement is income and that interest meets the criteria of substantial under I. C. 31, an increase could occur.
