Legal Question in Personal Injury in Indiana
I have a 17 year old daughter over whom I am still guardian. She lives in a two bedroom apartment shared with another disabled girl. They have a "provider" service that supplies 24-hour caregivers. One of the staff (the caregiver) decided to take my daughter and have bangs cut. NO ONE ASKED ME. She hasn't had bangs in years and I did not want bangs. They don't look good on her, she cannot do her hair (and they don't put any effort into it). Additionally, we now have to grow them out while she looks like an orphan. These children have enough problems without also looking bad.
Needless to say, I was very angry. My husband just about died when he first saw her. She came home for a visit and, oh my goodness, you should have seen the looks from my husband and other daughter!
Is this considered battery? They do not have carte blanche to do whatever they want. They said, "Haley said she wanted bangs." Haley told me they asked her and she said, "I don't care." If Haley could make decisions on her own, she would not be where she is in the first place. She is autistic and has epilepsy, among other problems. I would be grateful for your view on this.

Looking at hte big picture, are you happy with the care provided overall. Is your child doing well?
The bangs will grow out. Without knowing what the agreement for care states, I cannot tell you one way or the other whether this mistake in judgment is an abuse or a violation of your agreement.
