Legal Question in Personal Injury in Indiana

Battery charge

My ex-girlfriend and I had a physical confrontation in my home. I asked her to leave and she fought me, I pushed her down. She left the house after she called the police. A report was filed on 3/31/09 (date of incident) no charges filed on her behalf or mine. Relationship ended. Two weeks later she goes to the emergency room for unknown reasons and wants me to cover the expenses, stating I caused her injuries. No proof. Can she have me arrested after all this time has passed or pursue collection of medical bills? Please advise. Thank you. I'm not a violent man and have no criminal records of abuse/battery.

Well, she can try. And she might succeed. It depends on the injuries and whether it is probable that you caused them.

As for the battery charges, that will completely depend on whether she makes a criminal complaint and whether the police or a prosecutor think it should be pursued.(Four months is NOT a long time for a criminal complaint to be brought.)

It sounds to me like you should at least consult a lawyer, so you can be ready for whatever she does.

She can provide a report to the police or prosecutors office and a decision will be made whether to pursue a criminal action. She can file a small claims complaint against you in court to collect the medical bills.
