Legal Question in Personal Injury in Indiana

my boyfriend, daughter and I were coming home from shopping and a Big huge 120 + lb dog charged out of our neighbors apartment she left her door cracked he bit my daughter on her Forearm Punctured her skin I hit him in the head about 20x with my purse and he bit her thigh and then bit my boyfriends thigh from the back I kept hitting him and he never bit me or even looked at me when I kicked him the neighbor ran out to grab him and I fell on the floor....I called the police they came called animal control and they are taking him because she did not have current shot records.

Taking my daughter to the Emergency Room once the police and animal control Leave.

Can I sue her? This is ridiculous...My daughter lost her father 3 weeks ago and now she gets attacked by a dog...Always something :(

Can you sue? YES. WIll you win? You need to provide some more facts about the dog, neighbor's knowledge, and other issues. See an attorney in your community to represent your daughter's interests and get advice for her.

You definitely have a case. A dog owner has a legal duty/responsibility to keep his or her animal under control, and depending on circumstances, perhaps even muzzled.

I am presently handling a similar case in Lake County. You may have a case, depending on the breed of the dog and whether on prior occasions this dog has shown violence towards people.
